Who we are
SetGo is gym management software: an admin portal that gyms use to run memberships, payments, receipts, reminders and attendance, and a member app for Android and iOS. SetGo is a product of TechKnow, Third Floor, City Center Plaza, Karan Nagar, Srinagar, Jammu and Kashmir 190010, India, and is run by Yasir ("SetGo", "we", "us").
We sell SetGo to gyms, which are business customers ("the gym", "you"). A gym's members use the member app free of charge. These terms apply to gyms, their staff and their members. Some sections, such as fees and billing, apply only to gyms.
Accepting these terms
By signing up for, signing in to or using SetGo, you agree to these terms and to our privacy policy. If you use SetGo on behalf of a gym, you confirm that you are allowed to accept these terms for that gym. If you don't agree, please don't use SetGo.
If you and SetGo have signed a separate written agreement, that agreement wins where it differs from these terms.
Accounts and roles
- Gym owners and staff sign in to the admin portal with an email and password. The owner can give staff roles such as manager or front desk, and is responsible for who has access and what they do with it.
- Members sign in to the app with their phone number and a one-time code sent by SMS.
- Keep your password and sign-in codes to yourself. You are responsible for activity on your account. Tell us straight away if you think someone else has accessed it.
- Give accurate details and keep them up to date.
- You can delete your account at any time. See deleting your account.
The gym's responsibilities for member data
When a gym adds members and records details about them, the gym decides what to collect and why, and SetGo stores and processes that data on the gym's behalf. The gym is responsible for:
- having a lawful basis, such as the member's consent, for the data it records and the messages it sends
- the accuracy of what it records, including payments, dues and attendance
- only collecting what it needs, and handling optional data like ID cards carefully
- answering its members' questions and requests about their data, with our help where needed
How SetGo itself handles personal data is set out in our privacy policy.
Memberships, payments and the shop
SetGo is not the seller of gym memberships. When a member pays membership fees, whether online through Cashfree (in India) or at the desk, that payment and the membership it buys are between the member and the gym. The gym sets its own prices, terms and refund rules, and refunds of membership fees are the gym's responsibility.
Gyms can also sell their own products to their members through the in-app shop. The gym is the seller of those products and is responsible for them, their prices, delivery, returns and any taxes due.
Acceptable use
Don't use SetGo to:
- break the law, or record or share data you have no right to
- send spam, or messages members haven't agreed to receive
- upload anything harmful, abusive, misleading or that infringes someone else's rights
- try to access accounts, gyms or data that aren't yours
- interfere with SetGo, overload it, probe it for weaknesses, or get around its limits
- copy, resell or reverse-engineer SetGo, or use it to build a competing product
We may remove content or limit access to protect SetGo and its users.
Fees and billing
- Gyms pay for SetGo per gym, based on their number of active members. Plans are shown on our pricing page.
- In India, prices are in Indian rupees and include GST.
- Monthly plans are billed each month in advance.
- Yearly plans are charged at 10 months' price (2 months free) and paid in advance for the year.
- A one-time payment option is available, priced and described in a written agreement with us.
- Prices on our website are a starting guide. Your final price is agreed with the SetGo team before you pay, and that agreed price applies to you.
- We may change our prices. We'll tell you before a change affects you, and it takes effect from your next billing cycle, not during a period you've already paid for.
Refunds and cancellations are covered in our refund and cancellation policy.
When your gym grows
If your number of active members goes above the limit of your plan, you move to the next tier from your next billing cycle. We'll let you know before this happens. You don't pay extra for the period you're already in. If your member count drops, you can ask to move to a lower tier from your next billing cycle.
Late or missed payments
If a payment is overdue, we'll remind you first. If it stays unpaid, we may suspend the gym's access to SetGo until it is paid. While suspended, your data is kept, and access is restored once the payment is made. If an account stays unpaid for a long time, we may end it as described under termination below.
Outside India
In some countries SetGo is offered on early-access terms, with pricing in US dollars. These prices don't include local VAT or sales tax, which you are responsible for where it applies. Some features are available only in India today. For example, in-app online payments through Cashfree work only in India, so gyms elsewhere record payments at the desk.
Availability and changes to SetGo
We make reasonable efforts to keep SetGo running, secure and backed up, but we don't promise it will always be available or free of errors. We may need to take it offline for maintenance or updates, and we'll try to tell you in advance when we can.
We improve SetGo over time and may add, change or remove features. If we remove a feature that is central to how your gym uses SetGo, we'll tell you in advance.
Your data when you leave
Your gym's data belongs to your gym. If you stop using SetGo, ask us and we'll give you an export of your gym's member, plan and payment records in a common format such as CSV. Please ask before your account is closed or within 30 days after. After that we may delete it, apart from records we must keep by law.
Our intellectual property
SetGo's software, design, name and logo belong to us. Using SetGo gives you the right to use it for your gym while your account is active and paid. It doesn't transfer any ownership to you.
You keep ownership of what you put into SetGo, such as your gym's details, logo, photos and member records. You allow us to store, process and display it only so we can run SetGo for you. If you send us feedback or ideas, we may use them without owing you anything.
Limitation of liability
SetGo is a tool to help run your gym. You remain responsible for your gym's business decisions, records, taxes and dealings with your members.
To the extent the law allows:
- we are not liable for indirect or consequential losses, such as lost profits, lost business or lost revenue
- we are not liable for problems caused by things outside our reasonable control, including failures of internet, SMS, payment or hosting providers
- our total liability to a gym for any claim is limited to the fees that gym paid us in the 3 months before the claim arose
Nothing in these terms limits liability that cannot be limited by law.
Termination
- You can stop using SetGo at any time. How cancellation affects what you've paid is explained in our refund and cancellation policy.
- We may suspend or close an account that breaks these terms, misuses SetGo or stays unpaid. Where reasonable, we'll warn you first and give you a chance to fix the problem.
- When an account is closed, you can still ask for a data export as described above.
Changes to these terms
We may update these terms as SetGo changes. We'll change the date at the top, and if a change is significant we'll tell gyms by email, WhatsApp or in the portal before it takes effect. If you keep using SetGo after that, you accept the updated terms.
Governing law
These terms are governed by the laws of India. Any dispute will be handled by the courts at Srinagar, Jammu and Kashmir. Before going to court, please contact us so we can try to sort it out together.
